THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24412 OF 2017 ORDER:
The petitioner was working as Village Revenue Officer, Jammikunta Cluster of Jammikunta Mandal, Karimnagar District. While so, on the complaint lodged by some third party, the Anti Corruption Bureau (ACB) Officials registered a case against him in Crime No.05/RCT-ACB/2016 under Sections 7 and 13(1)(D) read with 13(2) of the Prevention of Corruption Act, 1988, and Sections 467, 468, 471 and 420 IPC, dated 13.06.2016. On the basis of the said registration of the crime, the petitioner was placed under suspension by proceedings of the third respondent dated 03.08.2016. When no enquiry was conducted, nor any orders were passed revoking the said suspension, the present writ petition was filed to consider the representations of the petitioner dated 01.04.2017, 18.03.2017, 31.01.2017 and 02.11.2016. Even after issuing notice before admission on 25.07.2017 and adjourning the case on 11.12.2017, the learned Government Pleader did not file any counter affidavit.
In the circumstances, the writ petition is disposed of directing the third respondent to complete the enquiry, if enquiry is pending against the petitioner, and take appropriate decision with regard to the revocation of suspension, pursuant to the representations of the petitioner dated 01.04.2017, 18.03.2017, 31.01.2017 and 02.11.2016, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
