THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6655 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 2 seeking anticipatory bail in the event of their arrest in connection with Crime.No.247 of 2023 on the file of Pahadishareef Police Station, Rachakonda, registered for the offences under Sections 307, 452, 427 and 509 r/w. 34 of IPC. 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioners are seeking relief of anticipatory bail. The allegation against the petitioners is that they have entered into the house of de facto complainant and attacked the injured. A-1 is the father of the de facto complainant. A-1 and complainant's mother were divorced. However, both these petitioners entered the house and the 1st petitioner attacked Shaik Shahid and other petitioner attacked another relative.

The medical certificates are filed which reveal that there are multiple abrasions over the right side of back of the first injured, which are simple in nature and the other injured also received multiple injuries according to medical legal record. Since, there are no injuries on any vital parts of the body, the 2nd petitioner can be granted relief of anticipatory bail. The 1st petitioner was involved in several criminal cases according to the Additional Public Prosecutor.

Accordingly, A-2 is granted anticipatory bail subject to the following conditions:-
1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Pahadishareef Police Station, Rachakonda on 07.08.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.2 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.2 shall appear before the concerned police as and when required for the purpose of investigation.
3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of
Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

The prayer of anticipatory bail as far as A-1 is concerned is dismissed.

Accordingly, the Criminal Petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
