THE HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.24770 OF 2006 ORDER:
Questioning the provisional assessment order dated 01.06.2006, issued by the 1st respondent demanding the petitioner to pay 50% of the estimated amount of Rs.42,481/-.
While admitting the writ petition, this Court directed that the disconnection shall not be effected and the petitioner's service connection continued with the supply of the power on condition of the petitioner depositing 50% of the demanded amount.
Learned counsel for the petitioner submits that the interim order granted by this Court has been complied with. A counter-affidavit has been filed by the respondents. A reference is made to Sections 153 and 154 of Electricity Act, 2003 (for short, "the Act") and the learned standing counsel for the respondents submits that the writ petition may be disposed of giving liberty to the respondents to take necessary steps to recover the balance amount by initiating the proceedings under Sections 153 and 154 of the Act. Learned counsel for the petitioner does not report any objections. Accordingly, the writ petition is disposed of giving liberty to the respondents to take necessary steps for recovery of the balance amount in accordance with law. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
