THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18995 of 2017 ORDER :

This writ petition is filed, under Article 226 of the Constitution of India, seeking a Writ of Mandamus declaring the action of the respondents in not closing the contract work under Agreement No.06 SE/ 2013-14, dated 12.02.2014, pursuant to the representation dated 20.04.2017 as illegal and arbitrary, and consequently sought a direction to the respondents to return the deposit as well as bank guarantee submitted by the petitioner.

Heard learned counsel for the petitioner as well as the learned Government Pleader for Irrigation for the respondents and perused the prayer and affidavit filed in support of the writ petition along with material.

The only grievance of the petitioner is non-consideration of its representation dated 20.04.2017 for closure of the contract work from not acquiring the loan to complete the remaining work and non-refund of the deposit amount with bank guarantee.

Having regard to the above, the respondents are directed to dispose of the representation submitted by the petitioner on 20.04.2017, within four weeks from the date of receipt of a copy of this order. Any further grievance of the petitioner is left open to agitate in accordance with law.

With the above direction, this Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
