WRIT PETITION No.16295 OF 2018 ORDER :
According to the petitioners, they have agricultural land in Sy.No.108/1 to an extent of Ac.3.20 guntas in Raghavapuram village, Sujathanagar Mandal, Bhadradri-Kothagudem district and the said land is located in scheduled area. They have been in occupation of the said land for more than 20 years. While so, on 03.03.2018, the Tahsildar (4th respondent) passed order under Section 6 of the Land Encroachment Act, 1905 to evict the petitioners from the subject land as the said land is Government land. Aggrieved thereby, petitioners preferred Land Encroachment Appeal before the Revenue Divisional Officer. Along with the appeal, petitioners have also filed stay petition. Learned counsel for petitioners submit that I.A.No.1 of 2018 is rejected without assigning reasons.

Learned Assistant Government Pleader fairly submits that liberty may be granted to the Revenue Divisional Officer to pass fresh orders assigning due reasons in support of decision. 3.
Having regard to the said submission, matter is remanded to the Revenue Divisional Officer to consider I.A.No.1 of 2018 in pending Appeal No.1 of 2018 afresh and pass orders by assigning reasons in support of the decision made, as expeditiously as possible, preferably within a period of three weeks from the date of receipt of copy of this order. 4.
Writ petition is accordingly disposed of. Till the order is passed in I.A.No.1 of 2018, status quo obtaining as on today shall be maintained. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
