This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as Accused No.1 in Crime No.569 of 2026 on the file of Rajendranagar police station, Hyderabad. The offences alleged against the petitioner are punishable under Sections 318 (4), 316 (2), 336 (2), 338 and 340
(2) of the BNS Act .

Heard Sri L.Ram Singh, learned counsel for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 3.
The case of the prosecution is that the de facto complainant came to the police station and lodged a report on 12.05.2026, wherein it is stated that he is the absolute owner and
possessor of land admeasuring 400 square yards situated at Narsa Reddy Colony, Bandlaguda, Jagir Village, Rajendranagar Mandal, Ranga Reddy District. The said property was acquired through registered Gift settlement deeds. It is alleged that on 23.08.1986 the petitioner illegally and fraudulently created an unregistered notarized agreement of sale by forging the signature of the original owner with an intention to grab the property. Hence, he requested the police to take necessary action on the complaint. Basing on the same, police registered a case against the petitioner for the aforesaid offences.

Learned counsel for the petitioner would submit that the petitioner is innocent of the offences alleged against her and she has been falsely implicated in this case. He further submits that the de facto complainant is no way connected with the subject property and only to harass the petitioner the present complaint is filed. The petitioner is aged about 68 years. Entire documents are in the hands of the investigating officer and no further investigation is required and hence, he requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offences alleged against the petitioner are serious in nature and all the documents are fabricated and the subject property is a valuable property; that
investigation is not yet completed and hence, he prays to dismiss the petition.

Considering the submissions made by learned counsel for both parties and the material on record, the complaint filed by the complainant itself shows that the investigation is totally basing on the documentary evidence and both the parties are claiming the property from the same subject property with different documents. Considering the above, this Court is inclined to grant bail to the petitioner subject to the following conditions: (i) The petitioner-accused shall surrender before the Station House Officer, Rajendranagar Police Station, Hyderabad District, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.
(ii) On such release, the petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.
(iii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
