HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14569 of 2006 ORDER :

When the matter is taken up for hearing, it has been contended by the learned counsel for petitioner that the petitioner is challenging the auction notice dated 30.06.2006, but no interim orders are granted by this Court.

Having considered the facts of the case, this Court is of the considered view that the cause in the writ petition does not survive. Accordingly, the writ petition is dismissed. However, liberty is given to the petitioner to challenge the impugned auction notice, if he is aggrieved of the action of respondents in taking over his land. No order as to costs.
