THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12253 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief: "to issue any order or orders, writ or Writs or direction more particularly one in the nature of Writ of Mandamus declaring action of the 2nd respondent in not taking any action on representation Dt:14-032016 of the petitioner and not promoting the petitioner as Asst. Manager though the petitioner's is fully eligible and qualified is illegal, arbitrary, violation of the principles of natural justice and Article 14, 16, 19 and 300A of the constitution of India and consequently direct the respondent to promote the petitioner as Asst. Manager in the interest of justice and equity and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case." 2.

Heard Sri Ch.Janardhan Reddy, learned counsel for the petitioner, and learned Government Pleader for Cooperation.

3. When the matter is called, it is submitted by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 14.03.2015 to the second respondent herein and no action has been taken on the said representation so far and a copy of the same is placed on record along with the writ petition as material paper. It is further requested by the learned counsel that necessary direction may be issued to the second respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter

and entitlement of the petitioner, directing the respondent herein to consider and pass appropriate orders on the representation dated 14.03.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.
