ORDER:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.1 in issuing notification, vide Rc.No.123/2009, dated 18.02.2009, for filling up the vacancies of fair price shop dealers by reserving Shop No.48 only for Backward Classes, though the same was meant for Open Category for the last few decades, without following the procedure, as illegal and arbitrary. At the hearing, Mr. P.Venkata Rao, learned counsel for the petitioner, submitted that the cause in this Writ Petition does not survive for adjudication.

In the light of the above submission of the learned counsel, the Writ Petition is dismissed as infructuous. As a sequel to dismissal of the Writ Petition, interim order, 03.3.2009, is vacated and WPMP.No.5547 of 2009 shall stand dismissed as infructuous.
