HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.3243 OF 2013 ORDER :

This writ petition is filed seeking the following relief: "....to issue appropriate Writ, order or direction, more particularly a writ of Mandamus, declaring the action of respondents in allowing access to the proposed petrol pump of respondent no.7 situated in RS.No.301 of Vijayawada-Bhadrachalam main road, NH-221, Kondapalli village, Ibrahimpatnam Mandal, Krishna District more particularly by providing approach/access through the private road of the petitioner in RS.Nos.297/P, 300/1P, 300/2, 300/3A, 301/1 and 301/2 as illegal, arbitrary and contrary to the provisions of Greater Hyderabad Municipal Act and violative of Art.300-A of the Constitution of India and consequently direct respondents not to provide such approach/access to respondent No.7 and pass such other or further orders, as this Hon'ble Court deems just and proper in the circumstances of the case."

The 2nd and 6th respondents filed counter affidavits stating that the subject land is a public road.

In view of the categorical statement made in the counter affidavit of the 2nd and 6th respondents, the Writ Petition is dismissed. However, the petitioner is at liberty to avail other remedies which are available under law. 4.
