ORDER:

Heard learned counsel for the petitioner and learned Government Pleader appearing for civil supplies.

2. Though the petitioner questions show cause notice, dated 26.02.2015, on various grounds, I am not inclined to entertain this writ petition against the said show cause notice inasmuch the said notice merely calls upon the petitioner to submit explanation with respect to the irregularities pointed out against her. However, the said show cause notice gives only 48 hours to the petitioner to submit explanation, for which the learned counsel for the petitioner states that is highly inadequate time.

3. Learned counsel for the petitioner draws attention to earlier order of this court in W.P.No.35301 of 2014, dated 25.11.2014, wherein this court issued certain directions. It is also stated that petitioner's authorization is valid upto the end of March, 2015 and as her authorization is not suspended, she is entitled to receive the stocks and supply the essential commodities.

4. In the circumstances, the writ petition is disposed of with the following directions:

1. As long as petitioner's authorization is in force, she is entitled to supply of the essential commodities in the fair price shop No.24 and she may be permitted to distribute the commodities in terms of AP Public Distribution System Control Order, 2001 and the orders of the Government issued from time to time.

2. To the extent of time granted for submitting explanation to the show cause notice, petitioner is granted one week time till 01.04.2015, within which petitioner shall submit appropriate representation against the said show cause notice.

3. The Revenue Divisional Officer shall thereafter consider the show cause notice, the explanation submitted by the petitioner, and the attending circumstances and pass a reasoned order.

With the above directions, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J March 13, 2015 Note:- Furnish copy by 16.03.2015.
