IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH FRIDAY, THE TWENTY SIXTH DAY OF FEBRUARY TWO THOUSAND AND SIXTEEN

Present

Between:

Muddalameni Rajanna, S/o. Chinnappa, Age 49 years, R/o. of Yarrakotapalli Gram Panchayat, Kalakada Mandal, Chittoor District & 5 others .. Petitioners AND Sri Ramakrishna, S/o. Father's name not known to petitioner The Mandal Parishad Development Officer, Kalakada Mandal, Chittoor District.

.. Respondent The Court made the following:

ORDER:

This Court disposed of W.P.No.18252 of 2015 on 27.08.2015 directing the petitioners to approach the Mandal Parishad Development Officer, Kalakada Mandal, Chittoor District (2nd respondent) and produce their disability certificates.

2. Learned Standing Counsel representing the respondents stated that no such disability certificates were produced and, therefore, there is no disobedience and the contempt case is not maintainable.

3. Learned counsel for the petitioners fairly submits that on 19.02.2016, the disability certificates were sent by Registered Post to the respondent, since the respondent was refusing to receive the same by hand.

4. Since the disability certificates were not received by the respondent, it cannot be said that the second respondent in the writ petition violated the orders of this Court warranting initiation of contempt proceedings and continuation thereof.

5. The Contempt Case is, accordingly, closed. However, it is open to the petitioner to complaint to this Court if no orders are passed even after disability certificates are received. There

shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed. _____________________ P.NAVEEN RAO, J Date: 26th February, 2016 KL
