Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent police in not taking action against the unofficial respondents, pursuant to the reports said to have been given on 06.04.2017 and 26.04.2017, as illegal and arbitrary.

Learned Government Pleader for Home, on instructions, would submit that pursuant to a direction given by the Deputy Superintendent of Police, the Station House Officer wanted to proceed with the investigation, but the SHO felt that it would be appropriate to record the statement of the petitioner/ informant as the report was sent by post, to the office of the Superintendent of Police.

Learned counsel for the petitioner would submit that the photographs and other documents as sought for by the police authorities are sent and as the petitioner is an employee working elsewhere, it would be difficult for him to attend to the police station frequently. He further submits that there is every likelihood of harassment by the unofficial respondents.

Having regard to the above submissions and taking into consideration the facts and circumstances of the case, the writ petition is disposed of directing the petitioner to approach the concerned police station on 20.07.2017 or 21.07.2017, on which date, the Station House Officer-respondent No.3, shall record the statement of the petitioner and then proceed in accordance with law, at the earliest. It is made clear that the respondents shall not harass or detain the petitioner in the police station. No costs. Consequently, miscellaneous petitions, if any pending, shall stand closed.
