HON'BLE SRI JUSTICE S.V.BHATT CONTEMPT CASE No.1217 of 2018 ORDER:
The Contempt Case is filed complaining disobedienc e of order dated 05.07.2017 in W.P.No.21917 of 2017. It is true that the respondent herein did not move in the matter within the time stipulated by this Court. The Assistant Government Pleader places on record the endorsement dated 19.05.2018 and submits that in principle the following decision is taken :- " .......
The petitioner has submitted his representation in the ref 2nd cited. The matter has been examined with reference to the records. The land of Ac.3.74 in Sy.No.957/ 1 of Galijerugulla village claiming by the petitioner was already assigned in favour of Smt. Arlagadda Kotamn long back and after her death it was succeeded by her legal heir Smt Bingi Adilakshmi W/ o. Lakshmaiah and she was also granted pattadar pass book and title deed vide 1B Khata No.870. At this stage, it is not possible to grant assignment in favour of the petitioner. Alternatively, it was decided to grant assignment patta for the Govt. land in Sy.No.957/ 2 and 957/ 3B in favour of the petitioner.
In compliance with the direction of the Hon'ble High Court of A.P., Hyderabad in the ref 1st cited, the petitioner is therefore informed that the assignment patta for Ac.2.64 in Sy.No.957/ 2 and Ac.0.64 cents in Sy.No.957/ 3B of Galijerugulla village will be given in his favour after getting this proposal approved in the District Assignment Committee as and when this committee is convened since the assignment patta has to be issued only after its approval in the Assignment Committee as per the instructions of the Govt. issued in the ref 3rd cited.
The statement made in the endorsement is placed on record and accepted.
The copy of endorsement is refused by petitioner and now the same is given to the learned counsel appearing for petitioner.
Keeping in view the limited direction issued by this Court and issuance of endorsement dated 19.05.2018, I am satisfied that the c ontempt case need not be pursued further. Hence, the Contempt Case is closed. As and when inaction, if still continues, notwithstanding the endorsement, liberty is given to petitioner to approach the Court of competent jurisdiction.
