THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Appeal Suit No.1463 of 1998 JUDGMENT:

On 30.01.2018, this Court noticed that there was no representation for the appellant on 23.01.2018 as well as on that day, 30.01.2018. It was further noticed that as there was no representation for the appellant earlier also, that is, on 18.12.2017, there was a direction to list the appeal under the caption 'for dismissal'. Accordingly, on 30.01.2018, this Court directed the Registry to list the appeal suit on 06.02.2018 under the caption 'for dismissal'. On 06.02.2018, Sri K.J.V.N. Pundarikakshudu, learned counsel, submitted that he was instructed to appear for the appellant in the place of Sri A. Bhaskara Chary, learned counsel, and sought time of two weeks. Therefore, this Court directed the appeal suit to be listed on 20.02.2018 under the same caption. On 20.02.2018, this Court further directed the appeal suit to be listed on 28.02.2018 under the same caption. When the appeal suit is taken up for hearing today, yet again there is no representation for the appellant. The conduct of the appellant indicates that the appellant is not interested in prosecuting the appeal suit.

In that view of the matter, the Appeal Suit is dismissed for default. There shall be no order as to costs.
