HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4143 of 2015 ORDER :

This criminal petition is filed under Section 482 Cr.P.C. by the petitioner/respondent seeking to quash the docket order, dated 24.12.2014, in Crl.M.P.No.153 of 2014 in O.P.No.441 of 2010 on the file of the Additional Family Court, Visakhapatnam.

2. Heard.

3. There is no illegality in the order passed for attachment of the salary of respondent towards arrears of maintenance and ordered notice to that effect.

4. The contention that before ordering salary attachment, notice is mandatory is untenable, as notice is already ordered.

5. Accordingly, the criminal petition is disposed of. If any grievance is there, it is left open to the petitioner to submit the same before the trial Court.
