HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.5259 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in Crime No.255 of 2015 of Chivemla Police Station, Nalgonda District, filed for the offence punishable under Section 420 IPC, on various grounds but the counsel for the petitioner requested to issue directions to the police concerned to follow the procedure under Section 41-A Cr.P.C.

Without touching the merits of the case, and acceding to the request of the counsel for the petitioner, this Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A Cr.P.C, and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar1. Miscellaneous petitions, if any, pending shall stand closed.
