HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.55 OF 2016 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-accused seeking anticipatory bail in connection with Crime No.184 of 2015-16 on the file of Prohibition and Excise Station, Medchal, R.R.District registered for the offence under Section 27(1) of A.P. Excise Toddy Rules, 2007. The allegation against the petitioner herein is that he was found selling adulterated toddy and when the toddy was sent for analysis, the toddy was found to be mixed with Alprazolam.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner contended that the petitioner has not committed any offence as alleged and, in fact, he is running the toddy shop by obtaining a valid licence.

Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein. Hence, the petitioner-accused is directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for the likesum each to the satisfaction of the Magistrate concerned. Further the petitioner is directed to report before the Station House Officer concerned, daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen days.
