THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9072 of 2016 ORDER:
This petition under Section 482 Cr.P.C. is filed by the petitioner/A.3 seeking to quash the proceedings in C.C.No.1569 of 2015 on the file of II AJCJ-cum- XIX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad against him. Heard the learned counsel appearing for the petitioner/A.3 and the learned Additional Public Prosecutor representing the State. A perusal of the complaint, discloses that there is material which is sufficient to proceed with the trial and prima-facie, it cannot be said that it is a fit case that the proceedings are liable to be quashed. It is also noticed that in the said C.C., in so far as nonpetitoner/A.2 the father-in-law is concerned this Court passed the following order :
"In any event, as the case is arising out of matrimonial dispute, the question of identity of the petitioner does not arise, and as such, the presence of the petitioner before the trial Court is dispensed with except on the dates when the trial Court insists for his appearance. The petitioner is directed to be represented by the counsel before the Court below on all hearing dates." In that view of the matter, this Criminal Petition is disposed of directing the learned Magistrate to proceed with the trial in C.C.No.1569 of 2015 and dispose of the same without further insisting for the presence of petitioner/A.3 on each and every adjournment, unless it feels that his presence is necessary for any specific purpose. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
