This Writ Petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in insisting to provide an undertaking or affidavit of 3rd respondent for deleting the surname of the petitioner in his passport as illegal and arbitrary and for consequential directions.
Heard learned counsel for the petitioner and Sri K.Arvind Kumar, learned Standing Counsel for respondents 1 & 2. Learned Standing Counsel for respondents 1 & 2, basing on written instructions dated 30.08.2019 submits that the petitioner has not made any application through online by enclosing necessary documents and that if petitioner approaches as per the procedure, they will take action in accordance with law. Recording the submission of the learned Standing Counsel, this Writ Petition is disposed of granting liberty to the petitioner to make appropriate application and on such application, respondents are directed to consider the same and take appropriate action in accordance with law.
