HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE Writ Petition No. 32813 OF 2010 ORDER:

Heard learned counsel for the petitioner. None appears for the respondents, though served.

Petitioner, in the instant writ petition, makes the following prayer:

"For the reasons stated above, I pray that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, order or direction, declaring the order of the 1st respondent in Proceedings No. F.SRO/NCTE/2009-10/12068, dated 28.4.2009 closing the application of the Petitioner pursuant to the communication said to be sent by the 2nd respondent dated 7.1.2009 with regard to change of policy of the State Government is contrary to settled principles of law and set aside the same and consequently direct the 1st respondent to take necessary steps for establishment of B.Ed. college and pass appropriate orders on the representation made by the petitioner and pass such other or further orders as are deemed fit and proper."

It appears from the impugned proceedings dated 28.4.2009, that a recognition to the petitioner's teacher training institute was refused. While admitting this writ petition, no interim order was passed by the Court.

In view thereof, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to make fresh application seeking permission to open the teachers training institute

The writ petition is disposed of as withdrawn with liberty as prayed. If the petitioner makes any such application, the concerned authority shall consider and decide the same strictly in accordance with law.

Consequently, pending miscellaneous applications shall also stand closed. No costs.
