THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2519 of 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.28 of 2016 on the file of the P.S., Mahankali, Hyderabad City, registered for the offence under Sections 406, 420 read with Section 34 IPC.
Heard and perused the material.
On perusing the material, this Court is of the view that even though the allegations stated in the complaint seems to be serious, the role of the petitioner herein that he introduced the other persons to the de facto complainant, on which they have paid the money to the person concerned. Considering the facts and circumstances, this Court is of the view that the presence of the accused before the Investigating Officer would help the Investigating Agency to investigate the matter further. Hence, the police concerned are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioner is directed to appear before the police concerned and cooperate with the investigating agency. The petitioner is also directed to submit an Undertaking for his future appearance for the purpose of investigation. If the petitioner fails to comply with the said undertaking, the respondent police are at liberty to file an application to recall the present order.
The Criminal Petition is accordingly disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 26.02.2016 pln
