ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.91 of 2016 of Miyapur Police Station, Ranga Reddy District, registered for the offence punishable under Section 384 IPC and under Section 3(1)(x) of SCs & STs (POA) Act, 1989, against her.

2. It is alleged in the complaint that the accused is the second wife of the husband of the de facto complainant and that as the accused failed to pay the loan installments regularly to the Baja Bank, the concerned Bank persons came to the house of the de facto complainant for recovery and with regard to that matter, when the de facto complainant and her daughters went to the house of the de facto complainant on 04.02.2016 at 12.30 PM., the accused abused them in filthy language in the name of her caste and extorted gold chain from the neck of the de facto complainant. Based on the said complaint, the aforesaid crime was registered against the accused.

3. Heard and perused the material on record.

4. Truth or otherwise of the allegations made in the complaint cannot be decided at this stage. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, as the petitioner/accused being a woman, the concerned police are directed to complete the investigation without making her arrest and file a final report, if any.

5. With the above direction, the Criminal Petition is disposed

of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
