A.Malakondaiah, S/o Ramakrishnaiah and four others.

..... Petitioners And:

Smt Sujatha Sarma, District Collector, Prakasam District and another.

....Respondents Counsel for the petitioners: Mr. I.Koti Reddy Counsel for the respondents: Mr. D.Ramesh Special Government Pleader (AP) The Court made the following:

CVNR, J CC.No.1853 of 2016 Dt:11.11.2016 ORDER:

This Contempt Case is filed alleging willful disobedience of order, dated 05.01.2016, in Writ Petition No.40031 of 2015. At the hearing, Mr.

D.Ramesh, learned Special Government Pleader (Andhra Pradesh), appearing for the respondents, submitted that the order out of which the Contempt Case arises was interfered with in the Writ Appeal to the extent of payment of interest by the respondents. Mr. I.Koti Reddy, learned counsel for the petitioners, did not dispute this submission.

Since the Contempt Case pertains only to non-payment of interest, with respect to which the Division Bench is stated to have interfered with the order of this Court, the cause in the Contempt Case does not survive for adjudication. The Contempt Case is, accordingly, dismissed. As a sequel to dismissal of the Contempt Case, Application No.893 of 2016 is also dismissed as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 11th November 2016 DR
