THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17833 OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Home. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in calling the petitioners everyday to Police Station and threatening to register false cases against them as illegal and arbitrary and consequently, to direct the respondents not to call the petitioners to the police station and not to register false cases.

3. At the time when the matter is taken up for hearing, learned Government Pleader placed on record the written instructions submitted by the Sub-Inspector of Police, Manuguru Police Station, wherein it is stated that basing on the report given by one Bhepalli Sudhakar, S/o. Rajalingu, Age: 51 years, Occu: SCCI Employee, R/o. PV Colony, Manuguru Mandal, Khammam District, a case in Crime No.148 of 2016 was registered at Manuguru Police Station for the offences punishable under Sections 109 and 366 IPC on 31.05.2016.

4. Learned counsel for the petitioners submits that he is not aware of registration of said crime and if any crime is registered, the petitioners will approach the appropriate forum for the relief. However, he further submits that the petitioners may not be summoned to the police station pursuant to the crime registered

except in accordance with law.

5. Since already crime is registered, petitioners are at liberty to avail remedies available under law. However, it is needless to mention that merely because a crime is registered, the authorities need not summon the petitioners to the police station except in accordance with law.

6. Accordingly, the Writ Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTICE C. PRAVEEN KUMAR Date:08.06.2016 INL
