The Aided And Private School Teachers Guild,Kurnool District v. The Government Of Andhra Pradesh, Hyderabad.

HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 21321 of 2002 O R D E R:- This writ petition is filed for the following substantive relief:

" ...to issue an order in the nature of Writ of Mandamus directing the respondents to upgrade S.G.T. Posts to those of School Assistants in U.P. Schools of Aided Managements by extending the benefit of G.O.Ms.No. 163 Education, dated 01.12.2001 and consequently declare that the member Teachers of the petitioner - Organization are entitled to up-gradation to those of School Assistants by holding the action of the respondents in not extending the benefit of G.O.Ms.No. 163 to Aided U.P. Schools, as arbitrary and illegal."

Heard Sri Ch.Jagannath Rao, learned counsel for the petitioner and the learned Government Pleader for School Education appearing on behalf of the respondents and perused the material placed on record.

The case of the petitioner - organization is that its members are working as Teachers and they are entitled to up-gradation to the posts of School Assistants in the light of the orders issued by the Government in G.O.Ms.No. 163, dated 01.12.2001. The member Teachers of the petitioner submitted representations dated 21.08.2002 and 30.12.2002, however, the same have not been considered by the respondents so far. Challenging the same, the present writ petition is filed.

AKS,J WP_21321_2002 The learned counsel for the petitioner submits that even though the member Teachers of the petitioner - organization are entitled to derive the benefit under G.O.Ms.No. 163, dated 01.12.2001, the respondents have not extended the benefit to them and prays that the respondents be directed to consider the representations of the petitioner. The learned Government Pleader submits that inasmuch as the member Teachers of the petitioner - organization have submitted their representations long back, the respondents will certainly consider the same and pass appropriate orders. In view of the above submissions, the writ petition is disposed of directing the respondents to consider the representations dated 21.08.2002 and 30.12.2002 said to have been made by the petitioner - organization and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
