THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38281 of 2015 ORDER:

The grievance of the petitioner was that the Station House Officer, Chaderghat Police Station, Hyderabad, was not taking any action on her complaint/representation dated 15.11.2015. This complaint was made in the context of the educational and other documents relating to the petitioner which were in the custody of respondent Nos.4 and 5.

Written instructions dated 27.11.2015 were furnished by the Sub Inspector of Police, Chaderghat Police Station to the office of the learned Government Pleader for Home, wherein he stated that the petitioner's complaint/representation dated 15.11.2015 had never been received by them. He however admitted that the petitioner had sent a petition dated 05.11.2015 by post to the police authorities stating that she had voluntarily left her maternal home on 03.11.2015 and that her marriage was solemnized in the Arya Samaj with her free will and consent. This petition did not have anything to do with the present complaint of the petitioner which is said to be embodied in the later representation dated 15.11.2015.

As the police authorities claim that they never received the said complaint, the writ petition is disposed of permitting the petitioner to make a fresh complaint in this regard to the Station House Officer, Chaderghat Police Station, Hyderabad. In the event the said officer refuses to receive the complaint, it shall be open to the petitioner to approach the Superintendent of Police of the District as provided under Section 154(3) Cr.P.C. If the petitioner's complaint is received, necessary further action will be taken thereupon by the police authorities in accordance with law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
