HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5419 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.2816 of 2018 on the file of the learned VI Additional Judicial First Class Magistrate, Warangal. 2.
A charge sheet came to be filed against the petitioner for the offences punishable under Sections 417, 420, 465, 468, 471, 472, 406 read with Section 120-B I.P.C.

Though the present Criminal Petition is filed seeking to quash the entire proceedings, today, at the hearing, learned counsel for the petitioner restricts his prayer seeking to dispense with the appearance of the petitioner before the trial Court on every date of adjournment. 4.
The learned Public Prosecutor submits that since the identity of petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the appearance of the petitioner in C.C.No.2816 of 2018 on the file of the learned VI Additional Judicial First Class Magistrate, Warangal, is hereby dispensed with except on the dates when his presence is specifically required by the Court. The petitioner shall be represented by a counsel before the Court below.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
