Heard the learned counsel for the petitioner and Sri A.Srikanth Reddy, learned Standing Counsel for the 3rd Respondent-Devasthanam.
According to the learned counsel for the petitioner, the petitioner is a proprietary concern bearing registration GST No.36240167576, dated.28-06-2017 and has been doing business in supply of Biodegradable covers mainly to the religious institutions in the States of Telangana and Andhra Pradesh. In response to the "e-procurement' tender notification published in the newspapers on 17-02-2018 for supply of Biodegradable covers to the 3rd RespondentSri Kalahasteeswara Swamyvari Devasthanam, the petitioner submitted its online tender. It is submitted by the learned counsel for the petitioner that the respondentsauthorities should have confirmed the contract in favour of the petitioner alone as it alone submitted the online tender in response to the above said notification.
It is further submitted by the learned counsel for the petitioner that totally ignoring the petitioner herein, the 3rd Respondent addressed a letter, bearing No.G1/ 942/ 2018, dated 18-032018 requesting the 2nd Respondent-Commissioner of Endowments to confirm the tender in favour of the 4th Respondent-unofficial respondent.
learned counsel for the petitioner, no further action pursuant to the said letter, dated 18-03-2018, has been taken so far by the 2nd respondent.
Since no approval has been granted so far by the 2nd Respondent pursuant to the letter, dated 18-03-2018 of the Executive Officer of the 3rd Respondent-temple, this court, in the facts and circumstances of the case, deems it appropriate to dispose of the writ petition permitting the petitioner herein to submit its representation before the 2nd respondent within an period of one(1) week from today highlighting its grievances and if any such representation is made within the time stipulated above, the same be considered and appropriate action be taken in respect of the claim of the petitioner herein in accordance with law by giving opportunity to all the stakeholders within a period of two(2) weeks thereafter. No costs. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
