HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.28822 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus directing respondents 2 and 3 to take cognizance of the offence under Section 420 IPC against the respondents 4 to 7 by registering FIR, investigate into and to file final report in the competent court on the complaint dated 30.07.2015 given to the 2nd respondent and complaint dated 31.08.2015 given on 01.09.2015 to the 3rd respondent, and pass appropriate orders as the court may deem fit and proper."
2. Heard Sri S. Madan Mohan Rao, learned counsel for the petitioner and learned Government Pleader for Home for respondents 1 to 3, apart from perusing the material available before this Court. 3.Today, when the matter is called, written instructions, dated 1410-2015 furnished by the Assistant Sub-Inspector of Police, Visakhapatnam IV town PS, Visakhapatnam City have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"It is respectfully submitted that on 12.10.2015 the station House Officer, Visakhaptnam IV Town PS, Visakhaptnam received the petitioner's complaint dated 31.08.2015 through the commissioner of Police, Visakhaptnam city. In the said complaint, it was stated that for the past 25 years he had been cinema producer, Cinema Distributor and exhibitor, Chairman of Film Chamber of Commerce, Joint Secretary contesting E.C. member and M.A. and enjoyed nominated posts. Further the petitioner paid Rs.30,000/- and Rs.50,000/- towards the members of his companies. The respondents 4 to 7 threatened and blackmail the petitioner and collected amount from the petitioner. The petitioner requested the police to take necessary action.
It is submitted that basing on the said complaint a case in Cr.No.462/2015 under Section 420 IPC has been registered on 12.10.2015 against respondents 4 to 7 herein on the file of Visakhaptnam IV Town PS, Visakhapatnam city and investigation has been taken up.
It is respectfully submitted that after completion of investigation the case will be finalized as per law and an appropriate report will be submitted before the concerned court as expeditiously as possible.
As stated above after forwarding the complaint of the petitioner herein on 12.10.2015 through the commissioner of Police, Visakhapatnam city the above FIR is registered against respondents 4 to 7 herein."
4. On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition.
5. In view of the above, the writ petition stands disposed of, by recording the written instructions, 14.10.2015 furnished by the Assistant Sub-Inspector of Police, Visakhapatnam IV Town Police Station, Visakhapatnam City. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs.
