THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4917 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioner/accused No.4 in the event of his arrest in connection with Crime No.98 of 2022, pending on the file of Karkhana Police Station, Begumpet Division, Hyderabad District, registered for the offences punishable under Sections 366(A), 328, 376(D), 109 I.P.C. and Section 5(g) read with 6 of Protection of Children from Sexual Offences Act, 2012.

Heard learned counsel for the petitioner/accused No.4 and learned Assistant Public Prosecutor for the respondent-State. 3.

The case of the prosecution is that the petitioner/accused No.4 is working in Sindhura Lodge, Kothapeta, subsequently, committed gang rape on a girl in the said Lodge.

In the said circumstances, it is not mentioned in the Remand Case Diary of the accused Nos.1 to 3 that this petitioner/accused No.4 had any knowledge about the purpose for which the room was taken. 5.

In the said circumstances, this Court is inclined to grant the relief of Anticipatory Bail to the petitioner/accused No.4 on the following conditions:

1) The petitioner/accused No.4 is directed to surrender before the Station House Officer, Karkhana Police Station, Begumpet Division, Hyderabad District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused No.4 on bail, on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/accused No.4 shall report before the said Station House Officer on every Monday between 10.00 a.m. and 5.00 p.m., for a period of three months or till filing of the charge sheet, whichever is earlier.

3) The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
