HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12885 of 2016 ORDER:

The petitioner filed this Criminal Petition under Section 482 Cr.P.C. praying to quash the order dated 22.08.2016 in Crl.M.P.SR.No.1429 of 2016 in PR No.473 of 2016, passed by the I-Additional Judicial First Class Magistrate, Kothagudem, Khammam District, and direct for release of 1263 kgs of Joggery in 63 boxes each weighing 20 kgs moulds, seized under PR No.473 of 2016 on the file of Prohibition and Excise Station, Kothagudem, Khammam District.

Heard and perused the records.

Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of directing the petitioner to file application before the Deputy Commissioner of Prohibition & Excise, Khammam, seeking release of above goods seized from the petitioner and on filing of such application, the same shall be disposed of within a period of one week from the date of filing.
