HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4513 OF 2017 ORDER:
This writ petition is filed for a writ of mandamus declaring the action of the respondents in demolishing the structures of the petitioners over their property bearing Plot Nos.46/7, 46/8 & 46/9 totally admeasuring 699 sq.yards in Sy.No.71 of Defence Colony, Langar House, Hyderabad on 22.09.2016, as illegal and arbitrary.
Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue submits that respondents are not claiming any right over the land in Sy.No.71.
It is to be seen that earlier W.P.No.2944 of 2012 is filed by the petitioners for the same cause of action and the same is disposed of vide order dated 04.09.2012 and the said order is still in force. But it is not known why the petitioners filed the present writ petition.
In view of the above, since the order granted on 04.09.2012 in W.P.No.2944 of 2012 is in force, petitioners cannot file one more writ petition for the same relief. Hence, the writ petition is dismissed. No costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
