This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.49 of 2014 on the file of XV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.
The whole grievance of the petitioner is that though the complaint was registered in January, 2005 and till date even after a lapse of 14 years, the case has not been completed because of the dilatory tactics of respondent No.2, due to which the petitioner is not only undergoing mental torture, but also losing his career opportunities and hence sought for quashment of the proceedings in C.C.No.49 of 2014. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for respondent No.1 - State. Perused the material on record.
Learned counsel for the petitioner contends that on earlier occasions also, though this Court twice directed the trial Court to dispose of the C.C.No.49 of 2014 within a time frame, the same could not be concluded due to the noncooperation of respondent No.2. A perusal of the record reveals that on earlier occasions also, though this Court directed the trial Court to dispose of
GSD, J Crl.P.No.5369 of 2019 the C.C.No.49 of 2014 within a period of three months, there is no progress whatsoever made in concluding the trial. Having regard to the facts and circumstances of the case, it is directed that the trial Court shall dispose of C.C.No.49 of 2014 within a period of two months from the date of receipt of a copy of this order. No further time will be granted hereafter.
Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
