Heard learned counsel for the petitioners and the learned Government Pleader for respondents.

The petitioners state that they are doing petty business for the last more than 100 years in the shops situated at Bazaar Street, Renigunta, Chittoor District, Andhra Pradesh, and they have been paying taxes regularly. When a notice was issued by the sixth respondent on 06.10.2017 asking them to remove the shops on the instructions of the District Collector, Chittoor; the Mandal Parishad Development Officer and the Tahsildar, Renigunta, the present writ petition is filed.

It is evident from a reading of the impugned notice dated 06.10.2017 that the notice was issued on the instructions of the District Collector, Chittoor; the Mandal Parishad Development Officer and the Tahsildar, Renigunta, and no opportunity was given to the petitioners to submit their representation on the proposed eviction. In the circumstances, the writ petition is disposed of directing the petitioners to treat the impugned notice dated 06.10.2017 as a show cause notice and it is open to the petitioners to submit their explanation to the said notice within a period of one week from the date of receipt of a copy of this order and on receipt of the same, the sixth respondent shall pass a reasoned order. Till a reasoned order is passed by the sixth respondent on consideration of the explanation submitted by the petitioners, no steps for eviction of the petitioners shall be taken. If the petitioners do not submit their explanation within

the time specified above, it is open to the sixth respondent to take appropriate action in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, shall stand closed. There shall be no order as to costs.
