Siva Sankara Rao) There is no application filed to set aside the award passed by the arbitrator and once such is the case, the revision petitioner has no locus to maintain the revision against the order passed in O.P.No.1 of 2009 under Section 17 of the Arbitration Act, 1940 making the award as rule of the Court.

Having regard to the above, the revision petition is dismissed. No order as to costs.

Interim order dated 05.03.2013 passed in C.R.P.M.P.No.1265 of 2013 shall stand vacated.
