Challenge in the present writ petition is opening and continuation of rowdy sheet against the petitioner herein under Police Standing Order 601. 2.

According to the learned counsel for the petitioner, in only one case petitioner suffered conviction i.e. S.C.No.143 of 2000 and the petitioner herein was also released prematurely on 15.8.2004 on the occasion of independence day. It is submitted by the learned counsel for petitioner that the rest of the seven (7) cases registered against the petitioner ended in acquittal. It is the further submission of the learned counsel for the petitioner that for opening of rowdy sheet, more than one conviction has to be recorded against the persons concerned in two consecutive years. It is the further submission of the learned counsel that in view of acquittal of the petitioner herein in all other cases, petitioner cannot be branded as a habitual offender.

On the other hand, it is submitted by the learned Government Pleader that in view of involvement of the petitioner in as many as five cases and a conviction under Section 302 IPC, the continuation of rowdy sheet against the petitioner cannot be faulted and the same is being continued in order to have a close watch on the movements of the petitioner. 4.

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the writ petition, leaving it open to the petitioner to make a written representation to the Respondent Police within a period of one week from today for deletion of his name from Rowdy Sheet and if any such application is made, the

Respondent Police shall consider the same within a period of one week thereafter and take appropriate action strictly in accordance with law by taking into consideration the mandatory requirements of Clauses (A) to (I) of Police Standing Order 601.

The writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
