THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6681 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.3 & 4 seeking anticipatory bail in the event of their arrest in connection with FIR.No.67 of 2023 on the file of Ramagiri Police Station, Ramagundam CP, Peddapalli District, registered for the offence punishable under Section 306 r/w.34 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioners and learned Public Prosecutor for the respondent-State and perused the record. 3.

The petitioners are arrayed as A-3 and A-4 for the crime registered under Section 306 of IPC. The case of the prosecution is that the deceased was a reporter in Vaartha daily newspaper. He committed suicide by standing in front of the train which ran over him. Initially, the case was registered under Section 174 of Cr.P.C. However, during investigation, it was found that the deceased had sent message to A-1/RAvinder Reddy for obstructing his work and troubling him. A-1 and A-2 were arrested. In the remand report, it is alleged that all the accused were jealous of the development of the deceased professionally and harassed him.

In the message sent by the deceased to A-1, nothing specifically was stated against these petitioners. 5.

Learned Public Prosecutor would submit that A-1 and A-2 were arrested and already released on bail.

Since the reason for arraying these petitioners as accused is the message that was sent on whatsapp, wherein nothing is specifically stated against these petitioners to draw inference of abetting the deceased to commit suicide, prima facie, this Court deems it appropriate to grant anticipatory bail, subject to the following conditions:

1) The petitioners/Accused Nos.3 and 4 are directed to surrender before the Station House Officer, Ramagiri Police Station, Ramagundam CP, Peddapalli District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/Accused Nos.3 and 4 on bail, on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.3 and 4 shall appear before the concerned police every day from 01.08.2023 to 17.08.2023 between 10.00 a.m. to 1.00 p.m. and thereafter, as and when required for the purpose of investigation.

3) The petitioner/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
