THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.17226 of 2016 ORDER:
This Writ Petition is filed aggrieved by the action of the 5th respondent in not receiving Tender Form, dated 19.05.2016 from the petitioner for new license agreement for 6 years to run the Hotel Business in Khammam Bus Station.
Learned Standing Counsel Sri B. Mayur Reddy on instructions submit that though the petitioner had purchased the tender schedule, he has not submitted the tender schedule by putting the same in the drop box and further submits that the tenders submitted by the tenderers have already been opened and finalised in favour of the third parties.
The grievance of the petitioner is that imposing a condition of a minimum turnover of Rs.50,00,000/- per annum in the tender notification is arbitrary and unjust. Since in this particular tender notification, where a condition has been imposed has already concluded, the relief of the nature sought by the petitioner cannot be considered at this stage.
Accordingly, the writ petition is dismissed. However, the dismissal of the writ petition shall not be construed as a constraint on the petitioner from challenging such condition in future. There shall be no order as to costs.
Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
