THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 28475 OF 2010 ORDER:

Heard the learned counsel for the petitioner and the learned Additional Standing Counsel representing respondent No.1. 2.

The prayer sought in the Writ Petition is as under: " ....o issue a writ, order or direction more in the nature of mandamus declaring the action of the 1st Respondent in issuing the impugned proceedings dated 10.3.2010 and the action of the Respondent No.4 in issuing the consequential order dated 23.6.2010 as illegal ab initio, void, contrary to the principles of natural justice, arbitrary and discriminatory offending the interests of the petitioner and consequentially the petitioner seeks a relief or a direction directing the District Collector, Khammam to consider the application of the petitioner for transfer of freedom fighters' pension sanctioned in favour of her late husband Ravella Janaki Ramaiah to her in the light of the prevailing legal provisions."

During the course of arguments, it is brought to the notice of this Court that by virtue of the interim orders passed by this court on 6.12.2010, respondent No.1 has issued proceedings No.52/ CC/ 140/ 2010-FF (HC) dated 4.4.2011, whereby the pension of the husband of the petitioner has been restored from the date on which it was suspended.

In the light of the same, learned counsel for the petitioner informs that no further orders are required in the Writ Petition. 5.

Therefore, the Writ Petition is closed as no further orders are necessary.

However, learned counsel for the petitioner has brought to the notice of this Court that the petitioner has submitted a representation dated 4.10.2010 before respondent No.3 for transfer

of the pension sanctioned in favour of her late husband to her account and seeks a direction to respondent No.3 to pass appropriate orders on the said representation. 7.

Taking the said submission into consideration, respondent No.3 is directed to consider the representation dated 4.10.2010 submitted by the petitioner and pass appropriate orders as per law within a period of eight weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
