HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9803 of 2015 ORDER :

This Criminal Petition is filed by the petitioners/A1 to A6 under Section 482 Cr.P.C seeking to quash the proceedings in S.C. No.533 of 2012 on the file of III Additional Metropolitan Sessions Judge, Nampally, Hyderabad, for the offence punishable under Section 307 r/w 34 I.P.C.

The defacto-complainant and the accused in person representing through advocates are present and they want to compound the above offences . A perusal of the material on record and even the final report filed by the police shows that the injured LWs.1 and 2 were sustained simple injuries, treated and discharged from the hospital immediately.

Though the offence under Section 307 I.P.C. is not compoundable under Section 320 Cr.P.C. by invoking Section 482 Cr.P.C. the same is compounded.

Accordingly, the Criminal Petition is allowed and all the proceedings relating to S.C. No.533 of 2012 on the file of III Additional Metropolitan Sessions Judge, Nampally, Hyderabad, are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.
