HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO Appeal Suit No.1812 of 1998 JUDGMENT:

Learned counsel for appellant filed a memo dated 13.02.2017 stating that when the matter earlier came up for final hearing, he intimated to the appellant about the stage of matter by way of registered letter but the said registered letter was returned with the endorsement "addressee expired, hence returned to sender". It is further mentioned in the memo that inspite of the best efforts, learned counsel could not get any further information regarding the appellant's whereabouts. He thus ultimately prayed the Court to call the party and pass necessary orders. Today when the matter came up for hearing, there is no representation for the appellant. As per the information of the learned counsel for appellant, the appellant passed away and it appears his LRs have not approached the counsel to give instructions. In these circumstances the appeal is dismissed as abated. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
