ORAL ORDER:
The award passed by the Labour Court on the dispute raised by the first respondent, is challenged by the petitioner corporation. First respondent is proper and necessary party. Since notice was not served, this Court by order dated 23.6.2011 granted time to the petitioner corporation to serve notice on first respondent and to file proof of service within a period of two weeks. This Court further ordered that in default, the writ petition insofar as first respondent is concerned shall stand dismissed without reference to the Court. As per the note of the Registry, notice as directed by this Court was not served and accordingly an endorsement was made dismissing the writ petition as against first respondent.
Since writ petition is already dismissed against first respondent, nothing survives in the writ petition and the same is liable to be dismissed. Accordingly, writ petition is dismissed. No costs.
