ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 to A6 and A8 seeking to quash the proceedings in C.C.No.441 of 2015 on the file of Judicial Magistrate of First Class, Atmakur, SPSR Nellore District, registered for the offences punishable under Section 498-A and 494 r/w 34 IPC and under Sections 3 and 4 of Dowry Prohibition Act, against them.
2. It is alleged in the charge sheet that A1, at the instigation of A2 to A8, used to harass his wife i.e., de facto complainant, mentally and physically to sell away the house property given by her parents and A1 also committed attempt to murder thrice. Based on the complaint, a case in Cr.No.52 of 2015 under Section 498-A, 494 r/w 34 IPC and under Sections 3 and 4 of Dowry Prohibition Act, was registered against the accused.
3. Since there are serious allegations in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings.
4. At this stage, learned counsel for the petitioners confined his argument to the extent that the presence of petitioners/A2 to A6 and A8 may be dispensed with.
5. Considering the said facts and circumstances of the case, the presence of petitioners/A2 to A6 & A8 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.
6. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
