HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7600 of 2024 ORDER :

Petitioner/accused has filed this petition under Sections 437 and 439 of Cr.P.C. seeking bail in Cr.No.33 of 2024 of P.S. Jainoor, registered for the offences under Sections 417, 420, 376(2)(n) and Section 506 r/w. 34 of IPC.

Heard Sri CH.Jayakrishna, learned counsel for petitioner/accused and the learned Additional Public Prosecutor appearing for the State.

Case of the prosecution is that the petitioner/accused has induced the victim/daughter of de facto complainant and forcibly participated in sexual intercourse with her, by saying deceitful words and making false promises that he would marry her. Further, when the victim came to know about the petitioner marrying another woman, she tried to commit suicide by consuming Harpic and immediately, she was shifted to hospital for treatment. 4.

Learned counsel for petitioner submits that the petitioner herein is innocent and falsely implicated in the case. He further submits that the petitioner and victim are majors and working as Doctors and the relationship appears to be consensual. He further submits that the

JS, J Crl.P.No.7600 of 2024 petitioner is in jail since 12.06.2024, and the entire investigation in the case is completed, and hence, prayed for grant of bail. 5.

The learned Additional Public Prosecutor, on the other hand, opposed the application stating that there are specific allegations against the petitioner herein, and hence, prayed to dismiss the petition.

Having heard both sides and perused the material on record, it is apparent that though the incident had occurred prior to 15.03.2024, the complaint was lodged on 24.03.2024 i.e., with a delay of about ten days, considering that the de facto complainant and the petitioner herein are majors and since the relationship appears to be consensual, this Court is of the considered view that it is a fit case for grant of bail subject to following conditions:

(i) The petitioner/accused shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties, for the like sum each to the satisfaction of the Judicial First Class Magistrate, Asifabad. (ii) The petitioner/accused shall abide by the conditions stipulated in Section 437(3) Cr.P.C.

Petition is accordingly allowed.
