THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11840 OF 2013 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue an order or direction more particularly, in the nature of writ of mandamus to declare the action of respondent No.1 in dabbling in civil matters of the petitioner as highly illegal and arbitrary.

Heard and perused the record.

Grievance of the petitioner is that respondent No.1 is interfering with the civil dispute between the petitioner and his landlords by visiting his place of business along with his personnel.

Respondent No.1 filed a detailed counter-affidavit wherein it is stated that respondent No.1 never interfered with any of the matters pertaining to the petitioner more particularly, the dispute between the petitioner and his landlords against whom a civil suit in O.S.No.706 of 2013 is pending on the file of the X Junior Civil Judge, City Civil Courts, Hyderabad; that the petitioner is facing a case in Crime No.166 of 2013 on the file of Jubilee Hills Police Station for the offence punishable under Section 420 I.P.C. and at the request of the Station House Officer, Jubilee Hills Police Station, the staff of this respondent assisted him for technical support in arresting the petitioner and others and except assisting the investigating agency of Jubilee Hills Police Station, this respondent never interfered with the civil matters as alleged in the affidavit.

Considering the facts and circumstances of the case and in view of the clarification given by respondent No.1 in the counter-affidavit, this Court is of the view that the Writ Petition is liable to be closed.

Accordingly, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
