HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 6433 OF 2017 ORDER:
This writ petition is filed seeking writ of mandamus declaring the action of the respondents 2 and 3 in refusing to register the Gift Deed executed by the petitioner in favour of her daughter vide rejection endorsement dated 07.05.2016 as illegal and arbitrary and consequently to direct the respondents 2 and 3 to register the said document.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
Learned Assistant Government Pleader for Revenue submits that the petitioner has alternate remedy of appeal under Section 72 of the Registration Act, 1908 against the impugned endorsement dated 07.05.2016 and same is not disputed by the learned counsel for the petitioner.
In view of the above, I do not see any reason to entertain the writ petition and accordingly the same is dismissed. However, the petitioner is at liberty to avail alternate remedy of appeal under Section 72 of the Registration Act.
There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
