THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CC.No.1514 of 2017 ORDER :

This Contempt Case is filed alleging willful disobedience of the order dt.12.07.2017 passed in WPMP.No.27159 of 2017 in WP.No.22058 of 2017.

The said order states as under :

"The learned Government Pleader for Education takes notice on behalf of respondents.

On the ground that there is an issue as to who is the Head Mistress of the Sherman Memorial Girls High School, Chittoor, Chittoor District, the 2nd respondent cannot stop payment of salaries to the teachers working in the said School since the question of who is the Head Mistress has nothing to do with the payment of the salary to the teachers and other non-teaching staff of the said School. Therefore, there shall be interim direction as prayed for." 3.

The learned Government Pleader for Education states that after this order was passed, in August, 2017 the salaries of all the employees (teaching and non-teaching) have been paid, except Smt. I. Thiru Arul Pavai on the ground that she has been placed under suspension, pending enquiry, on 20.04.2016 by the Special Officer and Deputy District Educational Officer, Chittoor. 4.

It is not the case of the counsel for petitioner that the said individual had questioned the said order placing her under suspension as of date.

The question of making payment of any salary to the said individual when she is under suspension, pending enquiry, does not arise. At best, she is entitled to subsistence allowance as per the applicable law which she is entitled to claim in a separate legal proceeding and by establishing her claim thereto. 6.

In this view of the matter, the Contempt Case is closed. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Contempt Case, shall stand closed.
