THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 345 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage. 2.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.2 in not registering the transactions of the petitioner over her plot on the basis of a letter dated 12.04.2012 issued by respondent No.3, as illegal and arbitrary. 3.

Learned counsel for the petitioner submits that the issue involved in the present writ petition is covered by the order dated 13.07.2016 passed in W.P.No.22077 of 2016. The same is not disputed by the learned Government Pleader for Revenue and learned Standing Counsel for respondent No.3.

Having regard to the above, the writ petition is allowed directing the Joint-Sub Registrar, Madhurawada - respondent No.2 to receive and process the documents presented by the petitioner in respect of plot No.281 admeasuring 666.67 square yards in Survey No.35 part of Rushikonda Village covered by VUDA layout in Survey Nos.34-Part and 35Part of Rushikonda Village, Visakhapatnam Rural Mandal, Visakhapatnam, without reference to the letter dated 12.04.2012, issued by VUDA. In the event, the document presented is found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Joint SubRegistrar, Madhurawada, shall complete the registration formalities and release the document in accordance with law. It is made clear that mere registration of document would not absolve the liability of the petitioner

and his successors-in-interest of legal action arising out of the enquiry that is stated to be pending with respondent No.3. There shall be no order as to costs.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
