HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20237 OF 2016 ORDER:

The case of the petitioner is that he is the absolute owner and possessor of the House No.2-27, admeasuring 1000 Sq.Ys at Bandaraipakula Village, which is the ancestral property of the petitioner and his name is also mutated in the Grampanchayat records as its absolute owner and possessor. While so, the Government issued notification as per the G.O.Ms.No.123 Rev. (JA&LA) Department dated 30.07.2015 & G.O.Ms.No.190 Rev (JA&LA) Department, dated 07.10.2015 for acquiring the lands for the purpose of construction of reservoir under Palamoor-Ranga Reddy Irrigation Scheme. In relation to the aforesaid notification, the Government also issued a separate notification dated 01.06.2016 for payment of compensation in respect of the houses situated at Bandaraipakula Village and the 2nd respondent Collector published the declaration dated 01.06.

2016 by mentioning the house numbers and its owners for the purpose of paying compensation. In the said declaration, the house No.2-27 is being shown as house existing in BC colony and the name of its owner is being shown as 6th respondent. In fact, it is the petitioner who is the absolute owner of the said house and entitled to be paid the compensation amount in respect of the said house. As such, the petitioner also submitted objection letter on 13.06.2016 to the 3rd respondent requesting to correct the ownership of the subject house. But, as no action is being taken, present writ petition is filed.

Reddy, learned Standing counsel for the 5th respondent and learned Additional Advocate General.

Since the application of the petitioner dated 13.06.2016 submitting objections is pending before the 3rd respondent, the 3rd respondent is directed to consider the same and take necessary action in accordance with law after issuing notice to 6th respondent.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
